Terms and Conditions

Introduction

The Victoria University of Wellington Students’ Association (VUWSA) membership programme is governed by the following terms and conditions.  If there is any conflict between what is set out in this information and anything a student and/or member has been told by VUWSA staff or its personnel, the terms of this information shall prevail.

Every student member is responsible for remaining aware of these Terms and Conditions. Every effort has been made to ensure the information provided to student members in relation to the VUWSA membership programme is correct.

These Terms and Conditions are effective as at 1 January 2012 and VUWSA reserves the right to amend the Terms and Conditions of the membership programme from time to time.

The VUWSA shall use all reasonable endeavours to advise student members of any such changes, but shall not be liable in any way for any failure to do so.

Definitions

VUWSA: means the Victoria University of Wellington Students’ Association
Member: means a student who has opted to join and is a current member
Member Only: means any of the specific facilities, services, arrangements or discounts offered or available to the student member during the period of membership
Goods: means all goods provided by the VUWSA
Services: means all services provided by the VUWSA
Terms and Conditions: means these Terms and Conditions as amended from time to time
Sticker: means the VUWSA member sticker is to be affixed to a Victoria University of Wellington student ID card

1. Use of your VUWSA membership

1.1 The Victoria University of Wellington student ID card with a current VUWSA member sticker affixed is required to be presented by the student member to access all or any “member only” services or departments of the VUWSA as part of the membership benefit package.

1.2 It is the sole responsibility of the student member to ensure they have their student ID card with a current VUWSA member sticker affixed at all times in order to access “member only” services and/or benefits. VUWSA membership is valid only for the member and is not transferable under any circumstances.

1.3 The student member’s VUWSA membership is valid only for the period indicated on the VUWSA member sticker affixed to their student ID card.

1.4 The VUWSA reserves the right to require the student member to produce their student ID card with a current VUWSA member sticker affixed at any time while utilising “member only” services or benefits.

1.5 In the event of loss or theft of a student ID card it is the responsibility of the member to inform the VUWSA in writing.

1.6 The VUWSA will not be liable for misuse of a lost or stolen student ID card.

1.7 In the case of misused, lost or stolen student ID cards a replacement sticker fee of $5 will be charged by the VUWSA. This is in addition to any charges the Victoria University of Wellington may require for replacing the student ID card.

1.8 The replacement sticker fee will be waived upon request under the following circumstances:

  • Stolen card: police report or reference number required
  • Faulty card: Card has an inoperable barcode.

1.9 The member shall be responsible for advising the VUWSA of any change of name or email address.

1.10 By affixing the VUWSA member sticker the member agrees to be bound by these terms and conditions.

2. General

2.1 This agreement is personal to the member which shall not assign its rights or delegate its performance hereunder.

3. Cancellation

3.1 Please note that members can choose to cancel their membership.  If the student member requests a cancellation of their membership they must notify VUWSA in writing.

4. Alteration of Membership Offer

4.1 The VUWSA reserves the right in its absolute discretion to withdraw, cancel, deny access to or in any way change any of the member benefits advertised or offered at any time and the VUWSA will not be liable for any loss or damage suffered by the member resulting from such withdrawal, cancellation or change.

4.2 The VUWSA reserves the right to suspend or terminate a student member’s membership for violation of its rules and regulations or for conduct deemed detrimental to the welfare of students and/or the VUWSA.

4.3 The VUWSA will only use the information provided to it from the student member in accordance with the Privacy Act 1993.

4.4 In the discharge of its duties the VUWSA shall comply with all reasonable resolutions, regulations and directions that may lawfully be made from time to time as to the nature and scope of the service to be provided. Nothing in the above clause shall effect the VUWSA’s right to exercise its own judgment and to utilise its skills as it considers appropriate in order to achieve compliance with the said resolutions, regulations and directions or otherwise with its obligations under this agreement.

4.5  All disputes relating to or arising out of this agreement:

  • Shall be governed by the law and policies of Victoria University of Wellington Students’ Association and/or Victoria University of Wellington
  • Shall be resolved in the New Zealand court with the appropriate jurisdiction

5. Privacy Policy

5.1 VUWSA is bound by the principles as set out in the Privacy Act 1993.

6. Collection of Personal Information

6.1 VUWSA collects personal information about students wishing to become members of the Students’ Association.

6.2 This information consists of name, contact details including, but not limited to: full name, address, email address, telephone number, student ID number, enrolment status and faculty.

6.3 VUWSA collects this information directly from the individuals concerned. VUWSA endeavours to ensure that the personal information it holds is accurate, complete and up-to-date.  It relies therefore on the individuals concerned to assist the Students’ Association in maintaining the accuracy of these records.

6.4 However, should the Student Union, in an attempt to contact a member within the normal course of business, find that the member has changed contact details including email address, address and phone number without informing the VUWSA, other sources for locating the member’s new contact details may be investigated: eg. Victoria University of Wellington.

6.5 VUWSA staff may request that a member intending on using the “member only” services provided by VUWSA produce their student ID card. Should a member be unable to do so VUWSA staff may request to see other documentation (such as driver’s licence or passport) for the purposes of membership identification.

7. Purpose of the Information Collected

7.1 VUWSA uses the personal information it collects from student members for the primary purpose of enabling those members to participate in any or all of the services VUWSA offers. VUWSA generally uses personal information to manage and enhance its services and to communicate with its members.

7.2 In the event you are required to provide member proof, this request for information is to ascertain whether a person has a right to use the “member only” VUWSA services and facilities and/or, in the case of suspected or demonstrated breach of VUWSA rules, the University Statutes, or the Law, in order to refer the situation to the relevant authority.

8. Consequences of Not Providing Information

8.1 A student member has the right of not providing VUWSA with any personal information. The consequence of not providing this information, as specified above, is that VUWSA will not be able to provide all “member only” services in all circumstances to that member.

8.2 A student member has the right to have their personal information deleted from VUWSA’s records. With this deletion the member forfeits her or his rights to utilise VUWSA “member only” services.

9. Protection of Data

9.1 VUWSA undertakes to protect the personal information it holds from misuse, loss, unauthorised access, modification or disclosure by various means including password access and secure servers. VUWSA will grant access only to those staff that requires personal membership information as part of their job requirement.

10. Sharing of Data

10.1 VUWSA does not disclose the personal information it holds to third parties.

10.2 As specified above, VUWSA may seek to maintain the accuracy of its records by requesting a student member’s personal information from Victoria University of Wellington.

11. Disposal of Data

11.1 At the beginning of each academic year, VUWSA purges its current student membership database.

12. Access

12.1 A student member has the right to access, examine and correct any information VUWSA holds on him/her.

13. Complaints

13.1 If a member is unhappy with this Policy or VUWSA’s practice/s in regard to his/her personal information, all enquiries or comments should be directed to the Communications Coordinator.
